Terms of use
In short: ZZP Accountant is a bookkeeping tool, not a tax adviser. You remain responsible for your administration and for every return you file. Always check the figures before you rely on them.
1. Who we are
ZZP Accountant is provided free of charge by Onur Senturk, a private individual in the Netherlands ("we"). You can reach us through the contact form. By creating an account you agree to these terms and to our privacy policy.
2. The service
The application helps sole traders in the Netherlands keep their books: invoices, purchases, bank transactions and reports such as a VAT overview. Accounts are by invitation only. We may change, suspend or end the service; where possible we give reasonable notice so you can export your data.
3. No tax, legal or financial advice
Nothing in the application or on this website is tax, legal or financial advice. Tax rules change and depend on your situation. Figures such as VAT amounts, VAT rates, returns, deductions and reports are produced automatically from what you enter and from rules we have implemented, and may be incomplete, out of date or wrong.
You are responsible for:
- the correctness and completeness of what you enter, including the VAT rate on each line;
- checking every figure, return and invoice before you send, file or pay it;
- filing your returns with the Belastingdienst on time and paying what is due;
- meeting your own legal obligations, including keeping your records for the required period.
When in doubt, check with the Belastingdienst or a qualified tax adviser.
4. Your account
- Keep your password and authenticator app to yourself. Two-factor authentication is required.
- Only enter data you are allowed to process, and use the service lawfully.
- Tell us promptly if you suspect someone else has accessed your account.
5. Your data
Your bookkeeping data remains yours. You can ask for an export at any time. How we handle personal data is described in the privacy policy.
6. Processing on your behalf
For personal data you enter about others, such as customers and suppliers, you are the controller and we are your processor within the meaning of article 28 GDPR. We:
- process that data only to provide the service and on your documented instructions, which are these terms and your use of the application;
- ensure that anyone with access is bound to confidentiality;
- take appropriate technical and organisational security measures, including encryption, two-factor authentication and access without shared passwords;
- use Microsoft Azure in the EU as sub-processor, and tell you before adding or replacing a sub-processor so you can object;
- help you respond to requests from the people concerned, and inform you without undue delay of a personal data breach;
- delete or return the data at the end of the service, unless the law requires us to keep it;
- make available the information needed to show we meet these obligations.
7. Availability
The service is provided "as is" and "as available". It sleeps when nobody uses it and can take a few seconds to start. We do not guarantee that it is always available, free of errors, or suitable for a particular purpose.
8. Liability
To the extent permitted by law, we are not liable for any damage resulting from use of the service, including tax assessments, additional assessments, fines, interest, lost profit, lost data or other indirect damage, and including damage caused by incorrect calculations or rates. If we are liable despite this, our total liability is limited to the amount you paid us for the service in the twelve months before the damage occurred.
Nothing in these terms limits liability for damage caused by our intent or deliberate recklessness, or any other liability that cannot be limited under Dutch law.
9. Ending your account
You can ask us to close your account at any time through the contact form. We may close an account that breaches these terms. In both cases we give you the opportunity to export your data first.
10. Changes
We may update these terms. The version and date at the top show the current version. For significant changes we ask you to accept the new terms before you continue using the service.
11. Law and disputes
These terms are governed by Dutch law. Disputes are submitted to the competent court in Amsterdam, unless mandatory law gives you the right to go to another court.
